By purchasing any Presency service or clicking "I agree" at checkout, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, do not complete your purchase.
Presency is a digital presence and business automation service operated by Axis Creative LLC, a Nevada limited liability company ("Company," "we," "us," or "our"). We provide subscription-based automation services to small businesses, including but not limited to missed call text-back, Google Business Profile optimization, review request automation, AI website chat widgets, and social media management.

Presency offers the following service tiers:
Service descriptions are provided for informational purposes. We reserve the right to modify, improve, or substitute individual service components with equal or greater alternatives without notice, provided the core value of the tier is maintained.
All new clients are required to pay a one-time Onboarding & Setup Fee of $400.00 USD prior to service activation. This fee is non-refundable under all circumstances as it covers time and resources expended in configuring your account.
Monthly subscription fees are billed automatically on the same date each month via the payment method on file. By providing payment information, you authorize Presency to charge your payment method on a recurring monthly basis until you cancel.
If a payment fails, we will attempt to process the charge up to three times over seven days. If payment remains unsuccessful, your services will be suspended until payment is received. We are not liable for any business impact resulting from service suspension due to failed payment.
We reserve the right to change subscription pricing with 30 days written notice to your email on file. Continued use of services after the effective date constitutes acceptance of the new pricing.
You may cancel your subscription at any time by emailing [email protected] with your business name and cancellation request. Cancellations must be received at least 7 days before your next billing date to avoid being charged for the following month.
Upon cancellation, your services will remain active through the end of the current paid billing period. No partial refunds are issued for unused days within a billing period. All automations, configurations, and integrations built by Presency on your behalf will be deactivated upon cancellation.
Presency reserves the right to cancel or suspend services immediately and without refund if a client violates these Terms, engages in abusive behavior toward our team, or uses our services for unlawful purposes.
No Refunds. All sales are final. The $400 onboarding fee is non-refundable under all circumstances. Monthly subscription fees are non-refundable once the billing period has begun. We do not offer prorated refunds for cancellations mid-cycle. If you are unsatisfied with our services, please contact us at [email protected] and we will work to resolve any issues.
Presency provides automation tools and digital presence services. We do not guarantee specific business outcomes, revenue increases, lead volumes, review counts, or search ranking improvements. Results vary based on your industry, market conditions, business quality, and factors outside our control.
We are not responsible for changes to third-party platforms (Google, Instagram, Facebook, Twilio, etc.) that may affect service functionality. We will make reasonable efforts to adapt to platform changes in a timely manner.

Presency is not liable for reduced service effectiveness resulting from client failure to fulfill these responsibilities.
All content, copy, automations, workflows, and configurations created by Presency on your behalf remain the intellectual property of Axis Creative LLC until your account is paid in full and in good standing. Upon cancellation and final payment, ownership of content specifically created for your business (such as written descriptions and social media captions) transfers to you. Automation blueprints, technical configurations, and proprietary workflows remain the property of Presency.
We treat all client business information as confidential. We will not share your business data, customer information, or account details with third parties except as required to deliver our services (e.g., Twilio for SMS, Google for GBP management) or as required by law.
To the maximum extent permitted by law, Axis Creative LLC's total liability to you for any claims arising from these Terms or our services shall not exceed the total amount you paid to us in the 30 days preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost business opportunities.
Before initiating any formal dispute, you agree to contact us at [email protected] to attempt resolution in good faith. Any disputes not resolved informally shall be resolved by binding arbitration in Clark County, Nevada, under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit against Presency or Axis Creative LLC.
These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Clark County, Nevada.
We reserve the right to update these Terms at any time. We will notify active clients of material changes via email at least 14 days before they take effect. Continued use of our services after the effective date constitutes acceptance of the revised Terms.
